Terms of Service

1. Definitions

1.1 "Service" means the FoxBlock image metadata removal service, including all associated software, websites, applications, and services provided by Company.

1.2 "Company," "we," "us," or "our" means FoxBlock and its affiliates.

1.3 "User," "you," or "your" means any individual or entity accessing or using the Service.

1.4 "Content" means any images, files, data, or other materials uploaded, submitted, or transmitted through the Service.

1.5 "Account" means the user account created to access the Service.

2. Acceptance of Terms

2.1 Binding Agreement. These Terms of Service ("Terms") constitute a legally binding agreement between you and Company. By creating an Account or using the Service, you accept and agree to be bound by these Terms.

2.2 Modifications. We reserve the right to modify these Terms at any time. Modifications will be effective immediately upon posting. Your continued use of the Service after modifications constitutes acceptance of the modified Terms.

2.3 Additional Terms. Certain features of the Service may be subject to additional terms and conditions, which will be presented to you at the time of use.

3. Eligibility and Account Registration

3.1 Age Requirement. You must be at least thirteen (13) years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

3.2 Account Creation. To access certain features, you must create an Account by providing accurate, current, and complete information.

3.3 Account Security. You are responsible for:

(a) Maintaining the confidentiality of your Account credentials
(b) All activities that occur under your Account
(c) Notifying us immediately of any unauthorized use
(d) Ensuring your Account information remains accurate and current

3.4 Account Termination. We reserve the right to suspend or terminate your Account at any time for violation of these Terms or for any other reason at our sole discretion.

4. Service Description

4.1 Metadata Removal. The Service removes metadata from uploaded images, including but not limited to EXIF data, GPS coordinates, camera information, and other embedded metadata.

4.2 FauxFox GPS Injector. Certain subscription tiers include access to the FauxFox feature, which injects randomly generated, entirely fictitious GPS coordinates and camera metadata into a processed image at the User's explicit request. The injected data has no relation to the User's actual location or any real-world device. FauxFox is a privacy tool intended to allow Users to satisfy platform requirements for location metadata without disclosing their actual location. By using the FauxFox feature, the User acknowledges and agrees that:

(a) The User is solely responsible for all uses of images processed with FauxFox;
(b) The User will not use FauxFox-processed images to commit fraud, misrepresentation, evidence tampering, impersonation, or any other unlawful act;
(c) The User will not use FauxFox-processed images to stalk, harass, deceive, or harm any person;
(d) Company provides the FauxFox feature as a neutral technical tool and bears no liability for the User's downstream use of processed images.

4.3 Service Branding. Processed images may contain an embedded software identifier tag ("FoxBlock.net | Privacy Shield") written to the image's EXIF metadata as part of standard processing. This tag is not visible in the image itself. Users may opt out of this tag through their account settings.

4.4 No Guarantee. While we make commercially reasonable efforts to remove metadata, we do not guarantee complete removal of all metadata due to variations in file formats and technical limitations.

4.5 Service Availability. We do not guarantee uninterrupted or error-free operation of the Service. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

5. Subscription Tiers and Pricing

5.1 Free Tier. The Free tier includes:

(a) Ten (10) images per month
(b) No storage (processed images must be downloaded immediately after processing)
(c) Ability to earn additional processing credits through advertisement viewing

5.2 Family Tier. The Family tier ($12.99 per month) includes:

(a) Two hundred (200) images per month
(b) Four (4) days of storage for processed images
(c) All supported file formats
(d) Bulk processing

5.3 Creator Tier. The Creator tier ($24.99 per month) includes:

(a) Six hundred (600) images per month
(b) Four (4) days of storage for processed images
(c) All supported file formats including RAW
(d) Bulk processing and advanced features

5.4 Agent Tier. Agent tier pricing and features to be announced at launch.

5.5 Annual Billing. Annual subscriptions are billed as a single upfront payment. Annual pricing reflects a discount compared to monthly billing. No refunds are provided for unused months of an annual subscription period.

5.6 Pricing Changes. We reserve the right to modify pricing at any time. Price changes will not affect current subscription periods but will apply upon renewal.

6. Billing and Payment

6.1 Payment Authorization. By providing payment information, you authorize us to charge the applicable fees to your payment method.

6.2 Automatic Renewal. Subscriptions automatically renew at the end of each billing period unless cancelled prior to renewal.

6.3 Payment Processing. Payments are processed by third-party payment processors. We do not store complete credit card information.

6.4 Failed Payments. If payment fails, we may suspend or terminate your Account and access to paid features.

6.5 Refunds. Refunds may be issued at our sole discretion within thirty (30) days of initial purchase. No refunds will be provided for partial billing periods.

6.6 Taxes. You are responsible for all applicable taxes associated with your use of the Service.

7. Acceptable Use Policy

7.1 Permitted Uses. You may use the Service to:

(a) Remove metadata from images you own or have authorization to process
(b) Use processed images for lawful personal or commercial purposes
(c) Access the Service through authorized interfaces and methods

7.2 Prohibited Conduct. You agree not to:

(a) Upload, transmit, or process illegal content, including but not limited to child sexual abuse material, terrorist content, or content that violates applicable laws
(b) Upload content that infringes intellectual property rights of third parties
(c) Use the Service to harass, stalk, threaten, or violate the privacy rights of others
(d) Attempt to gain unauthorized access to the Service, other Accounts, or computer systems
(e) Interfere with or disrupt the Service or servers or networks connected to the Service
(f) Use automated systems (bots, scrapers, etc.) to access the Service except as explicitly permitted
(g) Resell, redistribute, or sublicense the Service without written authorization
(h) Reverse engineer, decompile, or disassemble any portion of the Service

7.3 Content Monitoring. We do not actively monitor uploaded Content but reserve the right to review Content for compliance with these Terms.

7.4 Enforcement. Violation of this Acceptable Use Policy may result in removal of Content, suspension or termination of Account, legal action, or reporting to law enforcement authorities.

8. Disclaimers and Limitations of Liability

8.1 SERVICE PROVIDED "AS IS." THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

8.2 NO GUARANTEE OF RESULTS. WE DO NOT WARRANT THAT:

(a) THE SERVICE WILL MEET YOUR REQUIREMENTS
(b) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
(c) ALL METADATA WILL BE REMOVED FROM PROCESSED IMAGES
(d) ANY ERRORS IN THE SERVICE WILL BE CORRECTED

8.3 LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, OR DAMAGES EXCEEDING THE AMOUNT YOU PAID TO COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

9.1 You agree to indemnify, defend, and hold harmless Company and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

(a) Your use of the Service or any feature thereof, including the FauxFox GPS Injector;
(b) Your violation of these Terms;
(c) Your violation of any applicable law, rule, or regulation;
(d) Any claim by a third party arising from images you processed using the Service or the downstream use of such images;
(e) Any content you upload to the Service.

9.2 Company reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims.

10. Governing Law and Dispute Resolution

10.1 Governing Law. These Terms and any dispute arising out of or related to them or the Service shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles.

10.2 Informal Resolution. Before initiating any formal dispute process, both parties agree to attempt to resolve any dispute informally. You must send a written notice of your dispute to legal@foxblock.net describing the nature and basis of the claim and the relief sought. We will attempt to resolve the dispute within thirty (30) days of receiving notice. If the dispute is not resolved within thirty (30) days, either party may proceed to arbitration as set forth below.

10.3 Binding Arbitration. EXCEPT AS PROVIDED IN SECTION 10.5, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE RESOLVED EXCLUSIVELY BY FINAL AND BINDING INDIVIDUAL ARBITRATION. You and Company each waive the right to a trial by jury and the right to participate in class action litigation. Arbitration shall be conducted by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall take place in Wyoming, or, at your election, by telephone or video conference. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

10.4 Class Action Waiver. ALL CLAIMS MUST BE BROUGHT IN THE PARTY'S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

10.5 Small Claims and Exceptions. Notwithstanding the foregoing, either party may bring an individual claim in small claims court for disputes within the jurisdictional limits of such court. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights or unauthorized access to the Service.

10.6 Arbitration Fees. For claims under $1,000, Company will pay all AAA filing, administration, and arbitrator fees unless the arbitrator determines the claim is frivolous. For claims over $1,000, fee allocation follows AAA Consumer Arbitration Rules.
